On Wednesday evening, September 22, 2021, the President of the Republic, Kais Saied, issued a presidential order related to exceptional measures. This order included in Chapter Four final provisions stipulating the continuation of work on the Preamble to the Constitution, Chapters I and II thereof, and all constitutional provisions that conflict with the provisions of this Presidential Order.
The final provisions also provided for the abolition of the temporary authority to monitor the constitutionality of laws and draft laws.
The President of the Republic undertakes the preparation of draft amendments related to political reforms with the assistance of a committee organized by presidential order and submits them to a referendum for approval.
The draft amendments must aim at establishing a true democratic system in which the people are actually the sovereign and the source of powers.
The people exercise power through elected representatives or by referendum. This democratic system is based on the separation of powers and the actual balance between them. It also consecrates the rule of law, guarantees public and individual rights and freedoms, and achieves the goals of the December 17, 2010 revolution in employment, freedom and national dignity.
