A presidential order No. 117 of 2021 was issued in the Official Gazette regarding exceptional measures, and in its third chapter, the order established the powers and competencies of the President of the Republic.

By virtue of this order, the President of the Republic exercises executive power with the assistance of a government headed by a Prime Minister.

The President of the Republic represents the state and controls its general policy and basic choices.

 The following are the powers and authorities of the president in accordance with this order:

– The President of the Republic chairs the Council of Ministers and may delegate to the Prime Minister to preside over it.

The President of the Republic ensures the implementation of laws and exercises general regulatory authority. He may delegate all or part of this authority to the Prime Minister.

The President of the Republic exercises in particular the following functions:

* Supreme Command of the Armed Forces,

Declaring war and concluding peace after deliberation of the Council of Ministers,

Creation, modification and deletion of ministries and state secretariats, and control of their competencies and powers,

Creation, modification and elimination of public institutions, establishments and administrative departments, and the control of their competencies and powers,

* The dismissal of one or more members of the government or a decision on his or her resignation,

The accreditation of the country’s diplomats abroad and the acceptance of the accreditation of representatives of foreign countries to it,

* Appointment and dismissal in all senior positions,

* ratification of treaties,

* Special pardon.

Chapter 13 states that “the President of the Republic, if he is temporarily unable to carry out his duties, may delegate his powers to the Prime Minister by virtue of a presidential order.

During the period of this temporary impossibility of the President of the Republic, the government shall remain in place until this impossibility ceases to exist.

Article 14 stipulates that “when the position of the President of the Republic becomes vacant due to death, resignation or complete disability, the Prime Minister shall immediately assume the duties of the Presidency of the Republic until the return to the normal functioning of the state’s wheels is secured and he takes the constitutional oath before the Council of Ministers.

If at the same time an impediment occurs to the Prime Minister for one of the reasons referred to in the previous paragraph, the Minister of Justice shall temporarily assume the duties of the Presidency of the Republic.

In the last two cases, elections are held to choose the President of the Republic within a minimum deadline of forty-five days and a maximum of ninety days from the date of the vacancy.

The person in charge of the Presidency of the Republic takes the oath provided for in Article 76 of the Constitution.

Chapter 15 of this order states: The President of the Republic may submit to a referendum any draft decree. If the referendum leads to the approval of the draft, the President of the Republic shall issue it within a deadline not exceeding fifteen days from the date of the announcement of the results of the referendum.
