Presidential Order 117 regarding exceptional measures has resulted in many powers for the President of the Republic at the expense of the Prime Minister. Chapter 8 of it stipulates that the President of the Republic shall assume the executive authority with the assistance of a government headed by a head of government and that members of the government consisting of a head of government, ministers and state secretaries are appointed by the President of the Republic, according to article 16.

In this context, the Director of the Public Law Department at the Faculty of Law and Political Sciences in Tunis, Sghaier Zakraoui, explained to “JDD_Tunisie” that the government implements the choices determined by the President of the Republic. “

“The head of government directs the government, coordinates its work, and disposes of the wheels of administration to implement the directions and choices set by the President of the Republic,” meaning that the head of government runs and coordinates, and has powers and authority to dispose of the wheels of administration.For his part, the law professor interpreted this chapter as stating that the prime minister conducts government work, coordinates between ministers, and acts in the wheels of the administration as if he were the head of the administration, and these powers were in the 1959 constitution, but were abandoned during the ruling of Ben Ali.

Limited Powers

On the other hand, Professor of Constitutional Law, Mouna Kraiem, said that the powers entrusted to Prime Minister Najla Boudin do not exceed the level of implementation of the policies set by the President of the Republic.

And the law professor considered in a radio statement today, Thursday, September 30, 2021, that the powers granted to the prime minister are in line with the president’s assistant, the first minister, or the first ministers, adding that Najla Bouden Ramadan is the head of an interim government and not a designated head of government because she was appointed in accordance with Order 117 and not Chapter 89 of the Constitution.

Constitutional law researcher Rabeh Khraifi pointed out that the government has full powers, but the general policy is the policy of the President of the Republic.In his speech to “JDD_Tunisie”, Khraifi stated that the prime minister has full powers according to what Order 117 gives her, and the tasks and powers of this government are limited to exceptional circumstances, “which end with the end of exceptional circumstances.”The law researcher explained that the head of state had predetermined the most important points of the government program, in three main points: combating corruption, ending the tampering and corruption of state institutions, and managing and solving the problems of Tunisians (health, transport, education…).
