August 25: Are there New Decisions Concerning the Constitution and Parliament? Will be there a Caretaker Government?
It is expected that President Kais Saied will announce new decisions regarding the general situation in the country and everything related to governmental and parliamentary issues on August 25, 2021.
According to a reliable source close to Kais Saied, the President of the Republic is expected to announce, on the mentioned date, the temporary suspension of the constitution and the formation of an expert committee of constitutional law professors to formulate proposals for amending the political system and revising the constitution.
The same source stated that the freezing of Parliament will continue after the decision to suspend the constitution, in the context of continuing to take exceptional measures in accordance with what is stipulated in Chapter 80 of the Constitution.
It is also expected that Saied will announce the formation of a caretaker government on August 25.
To remember, the President of the Republic, Kais Saied, announced, on July 25, 2021, the freezing of all powers of the House of Peoples’ Representatives, the removal of the Head of Government, Hichem Mechichi, and the lifting of the immunity of deputies.
Chapter 80 states that “The President of the Republic, in case of imminent danger to the entity of the homeland, security or independence of the country, is unable, after consulting the Head of Government and the President of the House of Representatives and informing the President of the Constitutional Court, to take the measures necessary for that exceptional situation and announcing the measures in a statement to the people. These measures must be aimed at ensuring that the normal functioning of State offices is restored as soon as possible, and the House of People’s Representatives is considered to be in permanent session throughout this period. In this case, the President of the Republic may not dissolve the House of People’s Representatives nor may he submit a statute of blame against the Government.”
“Thirty days after the entry into force of these measures, and at any time thereafter, the Constitutional Court is entrusted with the request of the President or 30 members of the House of Peoples’ Representatives to decide whether or not the exceptional situation continues. The Court shall make public its decision no later than 15 days. Those measures will be brought to an end by the end of their causes. The President of the Republic shall make a statement thereon to the people.”
It is noteworthy that in March 2011, the Tunisian Constitution of 1959 was suspended and was temporarily replaced by the law on the temporary organization of public authorities until the approval of the new constitution for the year 2014 by the National Constituent Assembly.
