The President of the Republic Kais Saied promulgated, this Wednesday, September 22, 2021, a presidential decree relating to exceptional measures.It was decided to extend the suspension of all powers of the Assembly of People’s Representatives and the lifting of parliamentary immunity of all its members. He also put in all bonuses and benefits granted to the President and members of the Assembly of People’s Representatives.The same applies to the suspension of legislative and executive powers.

The legislative texts are taken in the form of decree-law, they are promulgated by the President of the Republic who orders their publication in the Official Journal of the Tunisian Republic, and this, after deliberation of the Council of Ministers. When enacting decree-laws, the achievements of human rights and freedoms guaranteed by the national and international legal system may not be undermined.

The first and second chapters of the constitution and all the constitutional provisions which are not contrary to the provisions of this Presidential Decree, continue to be applied.

Henceforth only the Preamble to the Constitution and the articles one relating to general principles and two relating to rights and freedoms as well as all the constitutional provisions which are not in contradiction with these exceptional measures, will remain in force.

It is worth mentioning that, the provisional body for the control of the constitutionality of draft laws has been abolished.The President of the Republic draws up draft revisions relating to political reforms with the assistance of a commission whose organization is fixed by Presidential decree.

These draft revisions must have as their object the establishment of a true democratic regime in which the people are effectively the holder of sovereignty and the source of the powers which exercise them through elected representatives or by referendum.
