French lawyers William Bourdon and Vincent Brengarth announced in an open letter published, on september 16th,2021 that they have filed an appeal with the Working Group on Arbitrary Detention which sits at the United Nations High Commissioner for Human Rights. male (GTDA) “for the purposes of considering that the placement under house arrest of their clients Chawki TABIB and Mohamed Anouar MAAROUF constitutes arbitrary detention”.

They recall that “the seizure of all powers by the President of the Republic Kais Saied left little doubt about the outcome of this procedure”.

It should be mentioned that, according to the lawyers, “their clients suffer the same fate as a hundred lawyers, magistrates, businessmen, etc who, for some, in the silence of the international community, have been placed under house arrest or at least are prohibited from leaving Tunisian territory despite the protests of numerous professional organizations and human rights organizations “.

Recall that, the two concerned filed a complaint with the Administrative Court in order to annul the decision of the head of the Department of the Interior. Imed Ghabri, spokesman for the Administrative Tribunal said earlier that ten complaints were filed by people placed under house arrest.

It is worth noting that, the High Commission on Human Rights’ Abusive Detention Team is one mechanism that examines such cases. The mission of the team formed by five independent and elected people is to verify the cases of detention and their compliance with international standards.
