In a post on her official Facebook page yesterday, Friday, August 6, the parliamentarian from the Heart of Tunisia party, Amal Ouertatani 2021, considered that the president’s nomination, for two leaders at the head of ministries, even if it exceeds a constitutional obstacle represented in the confidence of the Council as a direct condition that raises many problems at the level of running the public facility.

She explained that the problems are mainly represented in 4 points, the first of which is the inability to delegate the powers of running the departments, given that the legal text exclusively specifies ministers and state secretaries, which would disrupt the functioning of public utilities since the managers are not legally authorized to sign.

Secondly, challenge all contracts that may be concluded by them, or by whom they delegate to consider, due to the lack of legal capacity to sign contracts or issue authorizations.

Third, the administrator is not entitled to extract the salary of a government member or state clerk regardless of the work done, even if they exercise the duties of ministers in the absence of a correct designation.

Fourth, the possibility of appealing before the Administrative Court in all decisions of referral to the disciplinary councils, as well as the decisions of the councils themselves based on those referrals and their downfall (the jurisprudence of the Administrative Court is rich in this direction).

The spokeswoman indicated that it is a sound legal logic to put forward the overall legal problems that will soon be raised in the way public utilities are run by those charged with running who do not have the status of ministers in accordance with the provisions of the laws in force.
